A club apartment or vehicle can form part of the agreed consideration in a player contract. When the contract ends, the issue is not only when use stops. Condition, keys, documents, damage and the accounting of outstanding performance matter as well.

The label benefit in kind does not answer these questions by itself. The contract, the actual handover, the period of use and the agreed allocation of costs determine what has to be returned and how the final account should be prepared.

Describe the benefit clearly in the player contract

A club apartment and a vehicle are not interchangeable side issues. The contract should show what is provided, who holds the apartment arrangement or owns the vehicle, which costs are covered and how long use is intended to last. Any agreed private use should also have a workable framework.

Section 1151 ABGB describes a service contract as an agreement to provide services for a certain period. Where the player relationship contains employment-law elements, section 6 of the Austrian Employees Act may be relevant to the description of remuneration. It expressly refers to monetary and in-kind benefits. Whether and to what extent that classification applies depends on the contract and its actual performance.

Do not describe only a “benefit in kind”. Identify the actual item. For an apartment, the records should identify the property, inventory, keys and authorised users. For a vehicle, model, registration or vehicle identifier, accessories, mileage and the documents handed over are useful.

Regulate the period of use and running costs separately

Use may be linked to the start and end of the player contract, a season or a separate handover date. These points should not depend only on oral arrangements or isolated messages. A clear rule prevents the contractual end and the actual return from drifting apart without explanation.

The allocation of costs matters as well. For an apartment, the agreement may need to address operating costs, energy, internet, cleaning or repairs. For a vehicle, maintenance, insurance, tyres, fuel, parking and tolls may matter. These examples do not decide a claim, but they show why a final account should not merge every item into one unexplained total.

If the arrangement changes during the term, the amendment should state the date and new scope. A different apartment, another vehicle or changed private use can affect the earlier accounting and the return obligation. Keep the schedules and dated amendments with the latest contract version.

Club apartment: handover, keys and condition

For the apartment, the handover condition is the key starting point. A record should describe rooms, inventory, keys and visible defects. Dated photographs can supplement what was visible at handover or move-out. This helps distinguish ordinary wear from a specific alleged loss.

The return date should be coordinated with the contract end or a separate agreement. A transfer, early ending or release from duties may organise use differently from an ordinary expiry. The decisive points remain what the parties agreed and what was actually handed over.

Section 914 ABGB directs contract interpretation towards the parties’ intention and the practice of fair dealing. An unclear clause should therefore be read together with the handover, communications and actual contract practice. Section 915 ABGB provides supplementary rules for unclear statements where doubts remain.

Club vehicle: mileage, accessories and damage

A vehicle return should be recorded in a simple handover sheet. Include mileage, fuel or charge level, keys, registration and service documents, accessories and visible damage. A joint set of photographs reduces disagreement about whether a problem existed at handover.

Ordinary wear and a specific alleged loss are not the same. The review depends on the agreed use, duration, documented starting condition and actual return. A general statement that a vehicle was “damaged” does not make a final account traceable.

If an amount is requested for repair, cleaning or missing equipment, the item should be identified and supported by the relevant documents. That does not decide whether the demand is valid. It provides the basis for comparing the contract, condition and calculation in a focused way.

Final accounting of pay and benefits in kind

At the end of the contract, fixed pay, bonuses, expenses, outstanding payments and benefits in kind should appear as separate items. An apartment or vehicle should not disappear into an unexplained total. Each correction or demand should identify the agreement and period on which it relies.

Check whether the last account reflects the end of use, return and any outstanding costs in the correct period. For a vehicle, separate use during the term, return and later alleged repair costs. For an apartment, keys, inventory, condition and agreed cost items may affect the account.

Special cases: transfer, release and early ending

After a transfer, the last day of use may be earlier than the formal contract end. Conversely, an agreement may continue use until a handover or accounting date. These differences should be dated and connected to the contract end, release or termination agreement.

An early ending does not automatically answer every return and accounting question. The contract, amendments, handover and outstanding payments must be reviewed together. If the ending is disputed, first preserve communications and the actual handovers. A short chronology with date, person, item and supporting record is usually more useful than broad accusations made afterwards.

Avoid common mistakes in return and accounting

Recording only the contract end date: The end date and actual handover may differ. Record both and the agreement connecting them.

Accounting for apartment and vehicle together: The two benefits have different handover and evidence questions. Keep separate records.

Alleging damage without a starting condition: Photographs, inventory and a handover record make comparison possible.

Calling every deduction a benefit in kind: An outstanding bonus, repair demand and use item each require their own basis.

Using messages instead of an amendment: Material changes should remain traceable in a dated, agreed contract version.

Does use of the apartment or vehicle end automatically with the contract?
That depends on the agreement and actual handover. Check the return date, any continuing arrangement and the documented handover.

Who has to pay for damage to the apartment or vehicle?
There is no general answer. The contract, starting condition, actual use, cause and traceable amount of the demand all matter.

Is a benefit in kind automatically part of salary?
A benefit may form part of the consideration. Its legal classification depends on the contract and actual arrangement. Section 6 of the Austrian Employees Act refers to monetary and in-kind benefits where the Act applies.

What belongs in the final account?
Fixed pay, bonuses, expenses, outstanding payments and apartment or vehicle costs or demands should be shown separately, with period and contractual basis.

Which documents are needed for a review?
Keep the complete contract and amendments, handover records, key and inventory lists, photographs, vehicle documents, accounts and communications about the end of the contract.
